Upon consideration, genuine issues of fact remain as to the reasonableness of Plaintiff's distribution efforts and whether Defendant's termination of the franchise was made in good faith. On February 20, 2013, Defendant Louis Glunz Beer, Inc. ![]() terminated the exclusive beer distribution franchise for the state of Florida assigned to Plaintiff Micro Man Distributors, Inc. Micro Man sued, alleging a violation of § 563.022, Florida Statutes, which governs the relationships between beer distributors and beer importers. The parties' actions and claims must be understood within the context of § 563.022. The statute is therefore reviewed first, and then the undisputed facts giving rise to this lawsuit are described. The Statutory Schemeīecause they can sell directly to consumers only in limited circumstances, importers and manufacturers of beer must assign distributors for their products. We focus on the cost-effective application of technology for organizations of all sizes with a commitment to complete client satisfaction. Distributors are entitled to an exclusive sales territory for each product imported. Microman is a full service technology company with over 2,000 networks installed during our 32 years in business. The exclusive sales territory "shall be embodied in a formal written agreement," which must designate the brands for which the territory is granted and the exact geographical boundaries of the territory. The Florida Legislature strictly regulates the relationship between importers and distributors of beer. Youd think theyd honor your business and not mess with your schedule? Nope. We had a routine order of roughly 90 kegs every 10-15 days with them. The only good portion ive delt with are the drivers, they come in they do their job and they clean up, at least the drivers that do our routes. Cavalier and Micro Man send me an updated price aheet every 2 months and I dont even use them as a distributor. Have been asking 6 months now for something as small as an email of their pricing. ![]() Might be nice to work there, but horrible waiting for their service. Plaintiff is a licensed beer (malt beverage) wholesale distributor in Florida. FDC is the biggest trucking company that happens to ships beer and soda and makes money through cost cutting. Very disappointed with FDC, we have supported them and the brands they sell for 20 years., poor service and untrained sales people, no follow through with promotional schedules, slow to provide promotional material pricing tags, sales reviews, prompt delivery etcChanged both our delivery days and refused to change them and said we were not being good partners. ![]()
